Despite having been in force since the end of last year, many businesses are failing to comply with the terms of the Provisions of Service Regulations in respect of the information that must be provided to their customers.
What are the Regulations?
They are regulations implementing an EU directive with the aim of encouraging the provision of services between EU members by simplifying the process for providing those services.
Who needs to comply?
The Regulations apply to all businesses that provide a service (as opposed to, or in addition to, goods) operating within the UK, though there are a few narrow exemptions.
How do you comply?
Any business that is caught by the Regulations is required to give it’s customers the following information:
- Details of any trade or professional registration or membership of any authorisation scheme
- It’s VAT number
- Any standard terms and conditions
- The price of the service being provided
- Any after-sales guarantee
- The main feature of the service
- Details of any professional liability insurance
The information can be provided online, made available for inspection at the place where the service is provided, or sent to the customer directly.
The Regulations also require businesses to provide contact details for customer complaints; to respond to complaints as quickly as possible; and to use their best efforts to find a satisfactory solution to complaints.
