Pre Nuptial / Post Nuptial Agreements

Pre Nuptial Agreements:

It is not very romantic to consider the breakdown of your relationship before you have even embarked upon it but breakdown is a very real fact of life and a prenuptial can give you a degree of control over what will happen should it happen to you. Remember, it may not be just about you. It could be about providing for children from an earlier relationship or protecting assets that have been in your family for generations.

  • Decide whether yours is a case in which it is worth having a pre-nuptial agreement.
  • Understand what would be an appropriate division of assets should your marriage/civil partnership fail
  • Understand where you will  stand if your relationship did break down
  • Document any financial intentions at the beginning of the marital/civil partnership relationship 

In England and Wales pre-nuptial agreements are presently not legally binding but a court can and have taken them in to account.  We advise that if you do have any concerns about protecting your assets you should contact our Family Law team for more advice. The law may change in the next few years and they may become legally binding. For people who have a civil partnership the same applies.

POST NUPTIAL AGREEMENTS:

Post Nuptial Agreements are agreements entered into between couples after marriage which set out the provision to be made in the event of separation/ divorce. They will normally be binding provided they satisfy usual contractual principles, make provision for any children of the family and there has been no material change in circumstances since the Agreement was entered into.
