Ensuring Entitlement for your Spouse or Partner
When a loved one dies within a family the sharing of assets can cause disputes amongst yourselves as nowadays people are living longer and personal assets have grown. Due to extended life expectancies people head into old age without writing a Will which could cause complications in the long term if you become mentally ill or your domestic arrangements change.
The information below will talk you through why you should write a Will or encourage you to rethink the Will that you have already written:
Spouses rights:
You may want to provide for your spouse during their lifetime, however also ensure that your assets are preserved for the benefit of your children. Often spouses re-marry and this can affect your children’s inheritance. We can prepare a Will for you that guarantees income for your partner whilst at the same time secures your children’s inheritance.
Co-Habitants Rights:
A surviving co-habitant has no legal rights to share his or her partner’s estate on the death of their partner. But you can apply for provision if you were living with your partner for at least two years before their death.
